The Service
The Service is a multi-tenant CRM. Each workspace manages its own contacts and leads, pipelines, tasks, calendar events, notes, invoices, and transaction records, and communicates with those contacts by email, voice call, SMS/MMS text message, and the connected Facebook Messenger, Instagram, and WhatsApp channels.
The Service also includes automation (drip campaigns and lead routing), integrations with third-party systems, artificial-intelligence features, and the ability to connect outside AI clients. Each of these is described in its own section below.
You are responsible for the content of everything you send through the Service and for ensuring you have the necessary consent from every recipient.
Accounts and Access
You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
Workspaces have roles, and an administrator of your workspace can grant, change, or revoke what each member may see and do. You are responsible for who you invite and for the permissions you grant them.
Support access. Authorized A Brilliant Tribe INC. personnel may access a workspace, including by signing in as one of its users, to provide support, investigate abuse, or meet a legal obligation. Such access is logged and appears in the workspace’s own session list.
Acceptable Use
You agree not to use the Service to send unlawful, harassing, deceptive, or unsolicited messages, or to violate any applicable law or carrier requirement, including the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and CAN-SPAM. You must obtain and maintain proper consent from every recipient before messaging them.
Automation, bulk sending, and AI-generated replies do not change this. A message a campaign or an automated assistant sends on your behalf is your message, and the same consent, timing, opt-out, and content rules apply to it.
Your Data and Your Responsibilities
You retain ownership of the data you put into the Service. You grant us a limited right to host, process, and transmit it solely to provide the Service to you.
For the personal information of your contacts and leads, you are the controller and we are the processor. You decide what to collect and why; we process it on your documented instructions. You represent that you have the rights and consents necessary for every record you add, import, or capture — including data imported in bulk from another CRM, submitted through an inbound webhook, uploaded from a file, or imported from a device address book.
SMS / Text Messaging Terms
Program: Crumbse sends transactional and conversational text messages such as sales follow-up, appointment scheduling and reminders, service updates, and replies to inbound inquiries.
- Message frequency varies based on your interactions with the business.
- Message and data rates may apply. These are charged by your mobile carrier and are your responsibility.
- Opt out at any time by replying STOP to any message. You will receive a confirmation and no further messages unless you opt back in.
- For help, reply HELP or contact us at support@tristanahumada.com.
- Consent to receive text messages is not a condition of any purchase.
- Carriers are not liable for delayed or undelivered messages.
By providing your mobile number to a business using the Service, you consent to receive text messages related to your inquiry or relationship with that business. Your consent and mobile information are handled as described in our Privacy Policy and are not shared with third parties for marketing.
Voice Calls and Call Recording
The Service includes a browser-based softphone for calling contacts. Calls placed through the Service are recorded by default, on both sides of the conversation, and the recording is stored with the call record in your workspace.
Recording laws differ by jurisdiction, and several U.S. states require the consent of every party to the call. You are responsible for obtaining that consent and for announcing the recording where the law requires it, before or at the start of each call. If you cannot meet that obligation, do not use the calling feature.
Calls and recordings are carried by our telephony provider and are subject to that provider’s terms in addition to these Terms.
Email and Connected Mailboxes
You may connect a Google or Microsoft mailbox so that email you send and receive with your contacts is logged against their records. Connecting a mailbox authorizes the Service to read and send messages in that mailbox on your behalf, for that purpose only.
You may disconnect a mailbox at any time from the Service’s settings, and revoke access from your Google or Microsoft account. Our use of data obtained from Google APIs is limited as described in our Privacy Policy.
Messaging Channels (Messenger, Instagram, WhatsApp)
You may connect Facebook Page, Instagram professional, and WhatsApp Business assets so their conversations arrive in the Service’s shared inbox. Connecting an asset authorizes the Service to receive and send messages on it, and requires that you are entitled to administer that asset.
These channels are governed by the platform’s own policies in addition to these Terms, including its rules on messaging windows, message templates, and promotional content. A platform may restrict or disable an asset independently of us.
Calendar Integration
You may connect a Google Calendar so that events sync in both directions between it and the Service. Deleting or changing an event in one place changes it in the other. Disconnecting stops the sync but does not delete events already synced.
Automations and Drip Campaigns
The Service can enroll contacts in campaigns that send messages and create work on a schedule you configure, and can route and assign incoming leads by rule. You are responsible for the content, the timing, and the consent basis of everything a campaign sends, and for monitoring campaigns you leave running.
AI Features
The Service includes an in-app AI assistant that can read and change your workspace data on your instruction, and an optional AI receptionist that can reply to your contacts automatically on the channels you enable, without a person reviewing each message first.
- Output may be wrong. AI features generate text and take actions based on statistical models. They can be inaccurate, incomplete, or inappropriate for your situation, and nothing they produce is legal, financial, tax, or professional advice.
- You remain responsible. An action an AI feature takes in your workspace, and a message it sends to your contact, are yours. Review what matters before relying on it.
- Disclosure. If you enable the AI receptionist, you are responsible for disclosing to recipients that they may be communicating with an automated system where the law requires it.
- Processing. AI features send the relevant workspace content to third-party AI providers to produce a response. See our Privacy Policy for who those providers are.
- Your own provider key. A workspace may supply its own AI provider key, in which case that provider bills the workspace directly and that provider’s agreement with the workspace governs the processing.
We may impose usage limits on AI features, including monthly credit allowances, and may change or discontinue a model or feature where a provider changes or withdraws it.
Third-Party AI Connectors
You may connect an outside AI client — for example Claude or ChatGPT — to your workspace over the Service’s Model Context Protocol (MCP) endpoint. Doing so authorizes that client to read and change workspace data as you, limited to your own role’s permissions and to the scopes you approve.
- You choose the client. An AI client you connect is not our subprocessor. Once data reaches it, that provider’s own terms and privacy policy govern what happens to it, and we have no control over or responsibility for that.
- You are responsible for what it does. Actions a connected client takes are treated as your actions. Certain high-impact actions require an explicit confirmation from the client before the Service will perform them, but that safeguard does not transfer responsibility for the outcome.
- Credentials. Access tokens we issue to a connected client are scoped, expiring, and revocable. Do not share them. You may disconnect a client at any time from the Service’s settings, which revokes its access immediately.
- Availability. The connector may be disabled for a workspace by plan, by configuration, or where we reasonably believe it is being misused.
Inbound Webhooks and Imports
You may create inbound webhook endpoints so outside systems can write records into your workspace, and you may import data in bulk from a previous CRM or from a file. Each endpoint is authenticated by a token the Service issues to you once; you are responsible for keeping it secret and for everything sent with it.
You are responsible for having the right to import each record and for the accuracy of imported data. Imported history is loaded without triggering messages or automations.
Fees, Plans, and Billing
The Service is offered on a free plan and a paid plan. Features available on each plan are shown in the Service and may change.
- Subscriptions recur. A paid subscription renews automatically for successive periods at the then-current price until it is cancelled.
- Payment. Payments are processed by our payment processor. You authorize us and that processor to charge your payment method for each period. We do not store full card details.
- Cancellation. You may cancel at any time. Cancellation takes effect at the end of the period you have already paid for, and the paid features remain available until then.
- Refunds. Fees are non-refundable except where required by law, including for partial periods and for periods in which the Service was available but unused.
- Price changes. We may change prices. A change applies from your next renewal, and we will give notice before it takes effect.
- Failed payment. If a payment fails or a subscription lapses, the workspace reverts to the free plan. Data is retained, but paid features stop working and any content that depends on them becomes read-only or unavailable.
- Taxes. Prices exclude taxes unless stated. You are responsible for any applicable sales, use, VAT, or similar taxes.
- AI usage. AI features may be metered against a monthly allowance included with your plan. Exhausting the allowance suspends AI features until the allowance resets or is increased; it does not affect the rest of the Service.
Third-Party Services
The Service depends on third-party providers for telephony, email delivery, messaging platforms, payment processing, calendar and mailbox access, hosting, and AI. Their availability, terms, and policies are outside our control, and an interruption or change at a provider may interrupt or change the corresponding part of the Service. Our Privacy Policy identifies the providers that process personal information.
Intellectual Property
The Service, including its software, design, and content, is owned by A Brilliant Tribe INC. and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
If you send us feedback or suggestions, you grant us a perpetual, royalty-free right to use them without obligation to you.
Confidentiality
Each party may receive non-public information from the other. Each will use that information only to perform under these Terms and will protect it with at least reasonable care. This does not apply to information that is public, independently developed, or lawfully received from a third party, or to a disclosure required by law.
Disclaimers and Limitation of Liability
The Service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, that messages will be delivered, or that AI output will be accurate.
To the maximum extent permitted by law, A Brilliant Tribe INC. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service.
Indemnification
You will defend and indemnify us against claims arising from your data, your messages, your use of the Service in breach of these Terms or applicable law, or a third party’s use of credentials issued to you.
Termination
We may suspend or terminate your access to the Service if you violate these Terms or use the Service in a manner that creates risk or legal exposure for us or others. You may stop using the Service at any time.
After termination, your workspace data remains available for export for 30 days. At the end of that period we permanently delete it, and it is overwritten in our encrypted backups within a further 35 days. Suspension for non-payment does not by itself delete data. These periods match the ones set out in our Privacy Policy.
Governing Law and Disputes
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
